General Terms and Conditions for Participation in B2Run Running Events of Infront Sports & Media AG
§ 1 Scope of application - Validity
(1) These General Terms and Conditions (hereinafter "GTC"), as amended from time to time, apply to all B2Run running events (hereinafter "Events") organized by Infront Sports & Media AG, Grafenauweg 2, 6302 Zug (hereinafter "Organizer") and govern the legal relationship between companies and their employees as participants in the Events (hereinafter collectively "Participants") and the Organizer.
(2) All declarations by a Participant to the Organizer must be addressed to the Organizer at the address stated in paragraph 1.
§2 Conditions of participation - Safety measures
(1) Participation before the age of 16 is not permitted.
(2) Participation in the events with animals, baby carriages and wheelchairs is not permitted. Participation using sports equipment such as bicycles and e-bikes is not permitted. Excluded from this are Nordic walking poles of participants who are officially registered in the "Walking" category and who place themselves at the back of the starting field for safety reasons. If this is not followed, the organizer reserves the right to exclude participants from the event.
3) Participants are obliged to comply with all applicable mandatory regulations in connection with participation in the event. This applies in particular with regard to health and safety measures for the participants themselves and other persons involved in the event, which will be defined as part of a specific safety concept for the event if required.
4) The organizer shall announce all organizational measures to be observed by the participants in good time before the start of the respective event. The announcement will be made either on the organizer's website (www.b2run.ch), by mailing to the participants or directly on site on the day of the respective event. Participants are obliged to inform themselves about the specific organizational measures prior to arrival and to comply with them.
(5) The instructions of the organizer and its appropriately identified staff and security personnel must be followed. This also applies to instructions and measures in connection with the implementation of a safety concept or which otherwise serve the safety and health of the participants or other persons involved in the event. In the event of any infringements that may disrupt the proper course of the event or endanger the safety of other participants, the organizer is entitled to exclude the participant concerned from the event at any time and/or to exclude the participant from the time classification (disqualification).
(6) Participation in an event may only be advertised within the company or activated for PR purposes. It is generally prohibited to use the participation/starting places in an event for any kind of advertising to third parties who do not belong to the company of the participating company concerned or to carry out advertising activities at the event itself, unless there is specific written consent from the organizer.
(7) Legally binding declarations may only be made to the participants by the organizer's authorized group of persons. This group of persons includes in particular the event management on site, the members of the medical services supervising the event, who may also prohibit the participant from participating or continuing to participate in the event in the event of corresponding health indications for the protection of the participant.
§ 3 Registration - Participation fee - Terms of payment - Refund
(1) Before participants can register with their names for an event, the corresponding company / team must first be registered by a team captain with a customer account at B2Run, and starting places for the desired event must be booked by the team captain. The registration of a participant by name is then carried out via an individual registration page for the respective team. The team captain will receive the link to the corresponding individual registration page for forwarding within his team after booking starting places for the event in question. When registering by name, all participants must accept the organizer's terms and conditions, take note of the privacy policy and validate their registration by providing a valid e-mail address. Registrations by fax or other registrations by "electronic mail" will not be accepted unless B2Run expressly agrees to this in individual cases. If participants register by name by means other than via the individual registration page provided, each participant must nevertheless agree to the GTC and acknowledge the data protection declaration and validate their registration by providing an e-mail address. The same applies to subsequent changes to participants within a team. The team captain is generally free to make changes to participants who have already been named before the start of the event. The team captain can make changes online via his customer account or on the day of the event at the organizer's official information and registration desk. In such cases, the team captain shall ensure that the GTC and the data protection declaration provided by the organizer, as well as any safety concept, are made available to his team members. In cases where participants use a starting place at an event without prior registration by name in the organizer's system, the following applies: By booking the starting places, the team captain declares that he will make the GTC and the organizer's privacy policy available to all participants in his team and obtain the participants' consent to the GTC before the event.
(2) The respective participation fee will be invoiced by the organizer and must be paid within the respective deadline. Payments can be made with discharging effect to the bank details of the organizer. With the binding booking, electronic invoicing is agreed to.
(3) For companies that book at least 20 starting places, the organizer may reserve further starting places in addition to those booked. The starting places named within the reservation will be converted into a binding booking by the official registration deadline of the respective event. The reservation will then be cancelled.
(4) If the participant limit has not yet been reached and the organizational conditions permit, the organizer may also offer registration on the day of the event by cash payment or, if a customer account is available, on account.
(5) If the officially approved participant limit is lower than the number of registrations received, companies are taken into account in accordance with the order of the first booking for the event. In the event of non-approval, the participation fee already paid will be refunded. There is no entitlement to compensation in the event of non-approval.
(6) If a registered participant does not show up for the start, there is no entitlement to a refund of the participation fee.
(7) If a participant is unable to participate for medical reasons and submits a medical certificate to this effect, he/she will receive a free starting place for participation in the event in the following year. Alternatively, a substitute participant can be nominated for the same event.
(8) In the event of a complete, definitive cancellation of the event, the team captain will be informed of this and a refund of the participation fee already paid will be made by the organizer. In the event of a postponement to another day within the last 90 days before the original date of the event, the participant has the right to choose to have the participation fee already paid refunded or to take part in the postponed event or to take part in the event in the following year. The organizer will inform the team captain of the exact procedure for exercising the right of choice in good time together with the notification of the postponement. In the event of a postponement earlier than 90 days before the originally planned event and in the event of a postponement where the original day of the event remains unchanged, the participant shall not be entitled to a refund.
(9) If an event that has already begun has to be cancelled, the participant shall not be entitled to a refund.
§ 4 Disclaimer of liability
(1) The events shall take place in all weathers.
(2) If the organizer is unable to hold an event without substitution for reasons for which the organizer is not responsible and is therefore unable to provide contractual services or provide them in accordance with the contract, the organizer shall not be liable to pay compensation to the participant. The same applies in the event that an event is cancelled for reasons for which the organizer is not responsible.
(3) The organizer shall only be liable for damage to property and financial losses caused by gross negligence; excluded from this limitation of liability are damages based on the culpable breach of a main contractual obligation of the organizer and for culpably caused personal injury (injury to life, body or health of a participant). The above limitations of liability also extend to the personal liability for damages of employees, representatives, external agents and third parties whom the organizer uses in connection with the execution of the event or with whom he is contractually bound for this purpose.
(4) The organizer assumes no liability for health risks of participants in connection with participation in events. It is the responsibility of the participant to check his/her state of health beforehand; it is also the sole responsibility of the participant to take out appropriate insurance. Participation is at the participant's own risk. The organizer is not liable for injuries caused by other participants or external third parties.
(5) Offers from partners of Infront Sports & Media AG (commercial third parties) a. The implementation of offers from partners of the organizer is the sole responsibility of the partners. The organizer merely acts as an intermediary between the customer and the partner and excludes any liability. The Organizer's services are limited to collecting and describing offers and brokering these offers. b. A possible contract regarding the booking and execution of the respective partner offer is concluded directly between the customer and the respective partner. The fulfilment of the booked service as such does not constitute a performance obligation on the part of Infront Sports & Media AG. Infront Sports & Media AG is merely an intermediary.
§ 5 Data collection and utilization
(1) The organizer collects corresponding personal data for the purpose of the proper execution of the events. The handling of this data is regulated in the organizer's privacy policy, which applies to the event.
§ 6 Timekeeping, irregular behaviour
(1) A timekeeping chip will be issued for participation in the event. A warranty and/or liability of the organizer due to the defectiveness of the chip is excluded.
(2) The race number with integrated timing chip, which is issued by the organizer, must be worn clearly visible at chest height. If the race number is forgotten, lost or not worn, there is no right to participate.
§ 7 Award ceremony, categories
(1) The organizer reserves the right to exclude individuals and teams from the ranking in justified cases. As a general rule, legal recourse is excluded in connection with the naming of the winners of the scoring categories of the individual events.
§ 8 Final provisions
(1) Should any provision of these GTC be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The contracting parties are obliged to replace the wholly or partially invalid or unenforceable provision with a valid or enforceable provision that comes closest to the objective and purpose of the wholly or partially invalid or unenforceable provision in a permissible manner. Headings have a purely explanatory function and are non-binding.
(2) The place of jurisdiction for all disputes arising from this contract is - as far as permissible - Zug.
(3) Insofar as there are no mandatory statutory provisions to the contrary, Swiss law shall apply exclusively.
